Flight delay compensation: the full ladder of rights

Under Israeli law, your rights in a delay build up in steps. From 2 hours you get assistance. From 5 hours you choose between a refund and an alternative flight. From 8 hours the flight is treated as cancelled, which may give fixed compensation of ₪1,530-₪3,670 per eligible passenger, subject to the conditions and exceptions in the law. A delay just under or just over 8 hours can change the legal classification of the flight, so the actual departure time can be important evidence.

The delay ladder under the law

Delay is measured at departure, against the time printed on your ticket:

  • Less than 2 hours: no general right under the delay section of the law. The airline's contract terms may apply.
  • 2-5 hours: assistance: food and drink in line with the waiting time, plus communication (calls, messages).
  • 5-8 hours: assistance, plus a choice between a full refund of the ticket price and an alternative ticket. If the alternative is the next day, also a hotel and transfers. No fixed cash compensation at this stage.
  • 8 hours or more: the flight is treated as cancelled: fixed compensation of ₪1,530-₪3,670 per eligible passenger (by distance), plus a refund or alternative and assistance, subject to the exceptions in the law.

The common mistake: "I was delayed 6 hours, so I get compensation"

Not necessarily. Israeli law keeps the fixed cash compensation for a cancelled flight, and for a delay of 8 hours or more, which counts as a cancellation. A delay of 5-8 hours gives you other rights (a refund or alternative, your choice, plus assistance). Those are worth real money if you gave up the flight, but they are not the fixed compensation. Websites that promise "compensation for every delay" are not accurate.

This is exactly why the actual departure time matters so much. FlyBack keeps timestamped snapshots of the Ben Gurion flight board, with a SHA-256 fingerprint. They are useful evidence of the status and times shown when the data was captured. Other evidence, such as airline records, can also matter.

Delays caused by strikes, weather or "special circumstances"

Even after a long delay, the airline may argue it is exempt from the fixed compensation because of circumstances outside its control. The burden of proving that is on the airline, with concrete evidence, and assistance and the refund generally remain your right even then. In a declared special situation, the Minister may limit some assistance rights by order. More on the law itself: Israel's Aviation Services Law explained. If the airline already said no, read the airline rejected your claim.

Flying from Europe? Different rules may apply

The European regulation EC 261/2004 measures the delay on arrival, from 3 hours. It applies to flights departing from the EU, the EEA (Iceland, Norway, Liechtenstein) or Switzerland, on any airline, and to flights from Ben Gurion to those countries on an EU/EEA/Swiss airline. The UK has its own separate rules. See delays on flights from Europe (EU261).

Frequently asked questions

My flight was delayed 5 hours. What am I entitled to?

A departure delay of 5 hours or more, but less than 8, does not by itself give fixed cash compensation under Israeli law. What you do get: a choice between a full refund of the ticket price and an alternative ticket, mainly relevant if you gave up the flight, and assistance: food, drinks and communication, plus a hotel if the flight moved to the next day. From 8 hours the flight is treated as cancelled.

My flight was delayed 6 hours. Do I get cash compensation?

A delay of 5-8 hours does not, on its own, give the right to the fixed cash compensation. What you do get: a choice between a full refund and an alternative ticket (mainly relevant if you gave up the flight), and assistance: food, communication, and a hotel if you were moved to the next day. If you suffered actual damage, there may be other grounds that need an individual review.

When does a delay count as a cancellation?

From a departure delay of 8 hours. Section 1 of the law says a flight that took off 8 hours or more after the time on the ticket is treated as a cancelled flight, with all the rights that come with it: fixed compensation of ₪1,530-₪3,670 per eligible passenger, a refund or alternative, and assistance, subject to the conditions and exceptions in the law.

I flew in the end, after the delay. Do I get a ticket refund?

Not automatically. The refund right in a 5-8 hour delay mainly matters if you chose not to fly because of the delay. If you did fly, you are entitled to assistance according to your waiting time. If the airline did not provide it, reasonable documented costs for that assistance may be recoverable, so keep receipts.

Is the delay measured at departure or at arrival?

Under Israeli law the key question is the actual departure time compared with the time on your ticket. (Under the European regulation 261/2004, by contrast, the focus is the arrival delay. It applies to flights departing from the EU, the EEA or Switzerland, and to flights from Ben Gurion to those countries on an EU/EEA/Swiss airline.)

What should I keep so I do not lose my rights?

A photo of the flight board or the app showing the actual time, messages from the airline (with the time you received them), your boarding pass, and receipts for every expense at the airport. With FlyBack the main evidence is saved automatically: snapshots of the Ben Gurion flight board, fingerprinted.

My flight was delayed 3 hours. Is there compensation?

For an international flight under the ordinary Israeli delay rules, a 3-hour departure delay does not by itself give fixed compensation. It falls in the assistance band (from 2 hours: food, drinks and communication), and fixed compensation comes into play for a cancellation, or a departure delay of 8 hours or more, which counts as a cancellation. The 3-hour rule you may have heard of belongs to the European regulation 261/2004: it applies to flights departing from the EU, the EEA or Switzerland, and to flights from Ben Gurion to those countries on an EU/EEA/Swiss airline. Different rules apply to domestic flights within Israel.

What do I get for a hotel and food because of the delay?

Assistance depends on how long you wait, starting from a 2-hour departure delay: food, drinks and communication, and a hotel and transfers when the alternative flight is only the next day (sections 7(a) and 3 of the Aviation Services Law). If the required assistance was not provided, reasonable documented costs you paid to get it yourself may be recoverable, depending on the circumstances. Important: the assistance rights generally remain even when the airline is exempt from the fixed compensation, so keep your receipts.

I missed a connecting flight because of the delay. What am I entitled to?

Connecting trips need an individual check. A single booking and the final destination are important, but the airline that operated each leg and how the ticket was issued can also affect your rights under Israeli law. With two separate bookings, each flight is assessed on its own, and missing the connection does not by itself give a right against the first airline. We check these cases by hand, for free.

This is general information, not legal advice. Actual entitlement depends on the circumstances of the flight and the evidence.
