Terms of Use
Updated: 6 Nov 2026
1. General
FlyBack is a trade name of Itamar Avisris, Israeli VAT-registered sole proprietor, VAT ID 35994557 (the “Operator” / “we”). The website (the “Site” / the “Service”) helps passengers exercise their rights under the Aviation Services Law (Compensation and Assistance due to Flight Cancellation or Change of Conditions), 5772-2012, and under any other applicable law. Using the Site means you accept these terms.
2. What the service is, and what it is not
- The eligibility check on the Site is a first indication based on the official flight board data and on the provisions of the law. It is not legal advice and not a commitment to any outcome.
- The Operator is not a law firm and does not represent anyone in court. Cases are handled at the administrative level with the airlines, under a separate power of attorney and a separate service agreement.
- If legal advice or representation is needed, the passenger may engage an independent outside lawyer, under a separate agreement made directly between the passenger and that lawyer.
3. The fee, and what it covers
Opening and reviewing a case is free of charge. For compensation actually received, a success fee of 26% plus VAT at the statutory rate is charged. At the current VAT rate, this is 30.68% including VAT. The fee is calculated on the compensation actually received, under the service agreement signed when the case was opened. If no compensation is received, no FlyBack success fee is charged. Third-party costs of legal proceedings, if any, are separate and will be disclosed to you before they are incurred.
Price update: the fee rate was updated to 26% plus VAT on 16 Aug 2026. A case opened before that date continues under the rate set in the service agreement signed for it, and the binding rate is the one in the signed agreement of that case. A future price change will not apply to a case that is already open.
- The fee covers the full administrative service: the eligibility check, preparing the demand, collecting the evidence, tracking the deadlines and escalating with the airline.
- The fee is calculated on the compensation actually received (monetary compensation under the First Schedule, exemplary damages, or agreed compensation that replaces them). Ticket refunds, reimbursed expenses, interest and legal costs awarded to the passenger are not part of the fee base.
- How the money flows and how the fee is collected: when signing the service agreement, the passenger also signs a limited power of attorney and a payment instruction. Under them, the airline transfers the compensation to a separate FlyBack business bank account designated for receiving compensation payments on behalf of customers. It is not a lawyer's trust account. Once the account is credited, FlyBack deducts the fee under the agreement, issues a tax document as required by law, and transfers the full balance to the passenger within 7 business days, together with a statement of account. The tax invoice is provided at the same time, without the passenger having to ask for it. The passenger does not give any payment method and does not pay anything out of pocket. If, despite the instruction, the compensation is paid directly to the passenger, the passenger will tell FlyBack and pay the fee according to a detailed invoice that FlyBack will provide.
- No payment: if the airline does not make the payment required by law within the applicable statutory period, or does not otherwise resolve the demand, the case may be escalated. The passenger will be asked to sign a power of attorney for an outside lawyer, at no cost to the passenger, so that a warning letter can be sent to the airline.
- Small claims: if the demand is rejected, or is not answered even after the warning letter, the passenger may order the preparation of a small claims case file (including the documents sent to the airline, the registered mail receipts and the completed claim form), at no extra charge. The success fee applies to monetary compensation actually received as a result of the handling of the case, also if the passenger received the payment after filing a small claim personally, or as a result of a settlement or a judgment in proceedings the passenger conducted personally. The fee is not calculated on the court fee, a refund of the court fee, legal costs, or amounts awarded as reimbursement of expenses. The passenger files the claim in their own name and is the one who appears at the hearing. Advice before the hearing, or representation, if requested, will be provided by an outside lawyer, under a separate agreement of the passenger and the passenger's signature on a power of attorney and a fee agreement with that lawyer. FlyBack is not a law firm, does not give legal advice and does not represent anyone in court.
- Direct costs of legal proceedings (court fees, and service of documents or translation if required) are paid to those bodies directly and are not included in the fee. Engaging an outside lawyer, if needed, is subject to a separate fee agreement signed directly with that lawyer.
- The fee is collected from the amount received, never before it. In the period between receiving the payment and transferring the balance to the passenger, the balance is held for the passenger, recorded separately in FlyBack's books, and not used to offset any other debt.
4. Your obligations
- To give correct and complete information, and to tell us about any contact or payment from the airline.
- Not to file a parallel demand or claim for the same event while the agreement is in force.
- Not to use the Site in an automated, abusive or unlawful way.
5. Cancelling the agreement
The agreement is an ongoing transaction within the meaning of section 13C(a) of the Consumer Protection Law, 5741-1981, and the service is provided in stages: eligibility check and evidence collection, preparing the demand file, delivering it to the airline, follow-up and reminder, and escalation. The last two stages are conditional follow-up stages, carried out only if the airline did not pay after the delivery.
You have the right to cancel under the law. You can send a cancellation notice at any time through the dedicated page Cancel the agreement, by telephone, by email, by registered mail, or by any other cancellation method required by law. The contact details are in section 9. Once we receive the notice, we will send you a confirmation and further action on the case will stop.
If no demand has yet been delivered on your behalf to the airline, nothing is charged, including no cancellation fee. If the demand has been delivered, section 14E(b1) of the law applies. Under it, in an ongoing transaction where the service has already begun, the consumer pays the proportional consideration for the service provided. Any amount that may remain payable is limited to the amount permitted by applicable law and by the signed service agreement. FlyBack does not charge a separate cancellation fee. If compensation is later received as a demonstrable result of a demand sent before cancellation, any claim to a success fee is subject to the signed agreement and applicable law. The burden of proving the link between the demand and the payment is on us. No compensation received, nothing is charged.
6. Limitation of liability
The information on the Site is based on official sources and on the law in force when it is shown, but the law, including temporary provisions and orders, may change. There is no certainty about the outcome of any case. The Operator's liability is limited as set out in the service agreement, and nothing in this section derogates from mandatory provisions of law.
7. Intellectual property
All content, trademarks, design and code on the Site belong to the Operator or to third parties who have permitted their use, and may not be copied or used without permission, except where permitted by applicable law.
8. Governing law and jurisdiction
These terms are governed by Israeli law. Any dispute may be brought before a court that has jurisdiction under applicable law.
